STATE OF GEORGIA COUNTY OF HENRY NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in a Deed to Secure Debt, Security Agreement and Fixture Filing from ANGELS CREATIVE LEARNING ACADEMY INC. to FIDELITY BANK, dated April 17, 2017, recorded April 19, 2017, in Deed Book 15194, Page 6, Henry County, Georgia records, said Security Deed being given to secure a Note from ANGELS CREATIVE LEARNING ACADEMY INC. dated April 17, 2017 in the original principal amount of Two Million One Hundred Ninety Two Thousand and 00/100 ($2,192,000.00) Dollars, with interest thereon on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Henry County, Georgia, within the legal hours of sale on the first Tuesday in September, 2019, the following described property: All that tract or parcel of land lying and being in Land Lot 227 of the 7th District of Henry County, Georgia and being more fully described as follows: Commencing at the intersection of the western right of way of Georgia Highway 155 (100' R/W) with the northern right of way of Hunters Chase (80' R/W at this point), thence S 88 degrees 00 minutes 58 seconds W a distance of 219.65 feet to a punch hole made in concrete at the Point of Beginning; Thence along the said northern right of way of Hunters Chase (60' R/W at this point) thence S 88 degrees 00 minutes 58 seconds W a distance of 429.44 feet to a 5/8" rebar set; thence leaving said right of way N 07 degrees 25 minutes 38 seconds W a distance of 200.59 feet to a 1" open top pipe found; thence N 88 degrees 00 minutes 06 seconds E a distance of 440.77 feet to a nail set at the base of a 5/8" rebar found; thence S 04 degrees 11 minutes 33 seconds E a distance of 199.94 feet to a punch hole made in concrete at the Point of Beginning. Said tract of land contains 1.995 acres, more or less, having improvements thereon, and being known as 90 Hunters Chase, McDonough, Georgia 30253, and is more fully depicted on an ALTA/NSPS Land Title Survey for Angels Creative Learning Academy Inc., Fidelity Bank and Chicago Title Insurance Co. by Chastain & Associates, P.C. dated April 11, 2017 (File 217C14). Included herewith all fixtures, furniture, machinery, equipment, inventory, accounts, instruments, chattel paper and general intangibles. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
