NOTICE OF SALE UNDER POWER STATE OF GEORGIA, COUNTY OF HENRY By virtue of a Power of Sale contained in that certain Security Deed from Geneva L. Burden to HomeBanc Mortgage Corporation, dated January 25, 2002 and recorded on February 21, 2002 in Deed Book 4809, Page 73, in the Office of the Clerk of Superior Court of Henry County, Georgia, said Security Deed having been given to secure a Note of even date, in the original principal amount of One Hundred Twelve Thousand Seven Hundred Fifty and 00/100 dollars ($112,750.00) with interest thereon as provided therein, as last transferred to LoanCare, LLC, recorded in Deed Book 17030, Page 276, aforesaid records, will be sold at public outcry to the highest bidder for cash before the courthouse door of Henry County, Georgia, or at such place as has or may be lawfully designated as an alternative location, within the legal hours of sale on the first Tuesday in May, 2020, all property described in said Security Deed including but not limited to the following described property: All that tract or parcel of land lying and being in Land Lots 66 and 63, 12th District, Henry County, Georgia, being Lots 21, 22, 70 and 71, Block I, of Pinehurst Subdivision, Unit One, as per plat recorded in Plat Book 2, Page 185, Henry County Records, which plat is incorporated herein by this reference and made a part of this description. Less and Except: All that tract or parcel of land lying and being in Land Lot 66, 12th District, Henry County, Georgia being 31,108 square feet shown as part of Lot 70 and part of Lot 71, Block I, of Pinehurst, Unit One, as per plat of survey prepared for Precision Builders, Inc. by Donald R. Milligan, Registered Land Surveyor, dated May 9, 2000, and being more particularly described as follows: Begin at an iron pin located on the southeasterly right of way line of Oakland Blvd. (50 foot right of way), 121.0 feet southwesterly from the point formed by the intersection of said right of way with the westerly right of way line of Pine Street; thence south 32 degrees 26 minutes 54 seconds east, 125.25 feet to an iron pin; thence south 51 degrees 01 minute 48 seconds west, 226.27 feet to an iron pin; thence north 32 degrees 24 minutes 14 seconds west 151.58 feet to an iron pin located on the southeasterly right of way line of Oakland Blvd.; thence north 57 degrees 42 minutes 46 seconds east, 224.69 feet to the point of beginning. Said property may more commonly be known as 225 Pinehurst Drive, Stockbridge, GA 30281. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees (notice of intent to collect attorney's fees having been given). The individual or entity that has full authority to negotiate, amend and modify all terms of the loan is LoanCare, LLC, 3637 Sentara Way, Virginia Beach, VA 23452, 800-274-9900. Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will also be subject to the following items which may affect the title: a) zoning ordinances; b) matters which would be disclosed by an accurate survey or by an inspection of the property; c) any outstanding ad valorem taxes, including taxes, which constitute liens upon said property whether or not now due and payable; d) special assessments; e) the right of redemption of any taxing authority; f) all outstanding bills for public utilities which constitute liens upon said property; g) all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Security Deed. To the best of the knowledge and belief of the undersigned, the owners and party in possession of the property are Geneva L. Burden and or tenant(s). The sale will be conducted subject to 1) confirmation that the sale is not prohibited under the U.S. Bankruptcy code and 2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
