NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in the certain Deed to Secure Debt, Assignment of Rents and Security Agreement (hereinafter the "Security Deed") from Franklin Okojie and Veracruz Okojie (hereinafter the "Grantors") to Yale Mortgage Corporation dated October 16, 2007, and recorded October 24, 2007, in Deed Book 10546, Page 147, of the records of the Clerk of Superior Court, Henry County, Georgia Records; then assigned to Branch Banking and Trust Company by instrument recorded at Deed Book 10546, Page 166, aforesaid records; then assigned to Muller Real Estate Holdings, LLC by instrument recorded at Deed Book 12479, Page 171, aforesaid records; last assigned to MREH of Georgia, LLC (hereinafter the "Grantee") by instrument recorded at Deed Book 14513, Page 202, aforesaid records; originally having been given to secure a Promissory Note executed by Franklin Okojie in the original principal amount of $98,000.00, the property described in said deed will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Henry County, Georgia, within the legal hours of sale on the first Tuesday in SEPTEMBER 2019 (September 3, 2019), to wit: All that tract or parcel of land lying and being in Land Lot 161, of the 11th District, of HENRY County, Georgia, said tract containing 1.73 acres and being more particularly described as follows: To find the true point of beginning, commence at the intersection of the west side of Swan Lake Road with the southerly right-of-way line of Fairview Road; run thence westerly along said southerly right-of-way line 523.0 feet to the east side of a private road (30 feet in width); run thence southerly and southwesterly along said east side of the private road 454.1 feet to an iron pin and the True Point of Beginning; run thence South 59 degrees 51 minutes East 238.4 feet to an iron pin; run thence South 16 degrees 46 minutes West 356 feet to an iron pin on the northeasterly side of said private road; run thence along the side of said road the following courses and distances: North 46 degrees 36 minutes West 162 feet to a point; North 18 degrees 48 minutes West 187.7 feet to a point; North 16 degrees 26 minutes East 79.2 feet to a point; North 28 degrees 41 minutes East 109 feet to the Point of Beginning; being improved real property known as 1650 Fairview Road in accordance with the present system of numbering houses in Henry County, Georgia. All that tract or parcel of land lying and being in Land Lot 161 of the 11th District of Henry County, Georgia being designated as containing 2.921 acres according to a plat of survey for William A. Underwood and Robyn J. Underwood dated August 21, 1991 prepared by Alvin E. Vaughn & Assoc., Inc., certified by A. E. Vaughn, R.L.S. The debt secured by said Security Deed has been and is hereby declared due and payable in full by reason of default under the terms and provisions of said Security Deed and the terms of the Note and Agreements secured thereby. The debt remaining in default, this sale will be made for the purpose of paying the indebtedness and interest thereon, together with any other indebtedness due and owing by Grantor to Grantee MREH of Georgia, LLC including all expenses of this sale, including attorney's fees, notice of intent to collect attorney's fees having been given.
